Legal Liability to the Public and One Another: a Journey Through Facts and Fiction:

Andy is a partner with Clyde and Co. He has spent all his working life acting for insurers dealing with complex high value insurance litigation claims and brings a wealth of expertise to the liability field. Clyde and Co are on the RSA Insurance legal panel and have been nominated to deal with all future serious claims brought against MREW and any MR team.

As volunteers we give little thought to potential civil liability (at common law or by statute) or even criminal liability arising out of our charitable work, be that saving lives on the hill, undertaking educational visits or fundraising. Andy will explain ‘duty of care’, explore the impact of the Health and Safety at Work legislative framework, describe the core legal concepts and evaluate the (perhaps) mythical ‘Good Samaritan defence’. The risk of such liability should not stop what we do, but it is important we have an understanding of our legal obligations and associated risks. This high level walk through the issues will underpin much of what delegates will revisit in Sunday’s session with Chris Murray.
